Delta’s AI Terms of Service

These AI Terms of Service (“AI Terms”) apply when you access and use the generative AI tools and features, such as chatbots and AI-powered search, and other technology that Delta Air Lines makes available via our websites and mobile apps (collectively, “AI Tools”). These AI Terms are a legally binding agreement between you and Delta Air Lines, Inc. (“Delta,” “we” or “us”). By using the AI Tools and the information, content, tools, products and services on our websites and mobile apps (collectively, the “Service” or “Services”), you agree to be bound by these AI Terms, the Terms of Use and any other applicable terms and policies.

1.  Your Commitments

    A. Eligibility

Without limiting the Terms of Use or any other applicable terms or policies, the AI Tools are not intended for users who are (i) under the age of 16 or (ii) prohibited from receiving or utilizing our Services under applicable laws.

    B. Prohibited Uses

You may not access, use, or allow others to access or use AI Tools or any other part of the Services in order to:

  • Modify, reproduce, distribute, transmit, display, publish, sell, license, create derivative works of, or use any part of the Services or our intellectual property for commercial or public purposes, unless explicitly allowed by these AI Terms and the Terms of Use.
  • Republish, redistribute, or frame the Services on other websites or networked environments.
  • Disassemble, reverse engineer, or decompile any part of the Service.
  • Use automated tools (like robots or scrapers) to access the Service in a way that overloads our servers.
  • Use the Service’s content for AI training or identifying people.
  • Use the Service in a way that affects its stability, performance, or other users.
  • Take actions that put an unreasonable load on our infrastructure.
  • Use the Service for illegal, fraudulent, or harmful purposes.
  • Compete with us using the Service or develop competing products.
  • Access the Service through unauthorized means.
  • Bypass our security measures.
  • Interfere with the Service’s security or integrity.
  • Send spam, malicious code or viruses through the Service.
  • Impersonate others or hide your identity.
  • Collect personal information from the Service.
  • Imply any endorsement or affiliation with us without permission.
  • Claim any output from the Service as human-generated if it is not.

2.   Prompts, Results and Other Content

    A.  Rights to Content

The AI Tools may allow you to provide materials for processing, which could include text, documents, images, or recordings, depending on the integration (together, “Prompts”) and will generate a response (“Outputs”) based on your Prompts. The Outputs and Prompts, together with any feedback you provide (“Feedback”), are, collectively, your “Content.” You may not provide Prompts or use the AI Tools in any way that infringes or violates someone else’s rights, including intellectual property rights. Except as expressly provided in these AI Terms, you retain all right, title, and interest – including any intellectual property rights – that you have in and to your Prompts. You agree that your provision of Prompts will not violate these AI Terms, including the other policies that apply to your use of AI Tools, which we may supplement, update, or revise, at any time.

Delta may use your Content and related information, and may do so through automated or manual (human) review and through third-party vendors in some instances, including:

  • To provide, maintain, and improve the Service, AI Tools and our other services and features, including to train artificial intelligence models and machine learning algorithms;
  • To conduct and support research;
  • To monitor your use of our AI Tools for compliance with these AI Terms and applicable laws and to report violations of applicable laws or regulations as required by law;
  • To remove unsafe, discriminatory, or other Content that violates these AI Terms or any other applicable policies and terms; and
  • To suspend, block or remove users or accounts that violate these AI Terms.

    B.  Personal Information

The Delta Privacy Policy governs our processing of personal information collected through our AI Tools and explains how we collect, use, and share personal information – including personal information you submit as Prompts, Feedback or other Content, your activity across our products and personal information we collect from and about your device. 

    C. Third Party Links

Output may contain links to other websites not operated or controlled by Delta. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored, or checked for accuracy or completeness by us. Please remember that when you use a link to go from the AI Tools to another website, our AI Terms are no longer in effect. Your browsing and interaction on any other website, including those that have a link on our Services, is subject to that website’s own rules and policies. Such third parties may use their own cookies or other methods to collect information about you. You acknowledge and agree that Delta shall not be responsible for any third-party links, content, or other services (“Third Party Services”), including their accuracy, completeness, timeliness, validity, accessibility, copyright compliance, legality, decency, quality, or any other aspect thereof. Delta does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third Party Services. Third Party Services, content and links thereto are provided solely as a convenience to you and your access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

    D. Suspension and Termination

If we determine that you have breached these AI Terms, the Terms of Use, or other applicable terms and policies, we may suspend, block or permanently disable your access to the AI Tools, Services, and other Delta services or features, and we may permanently disable or delete your account including in any instances where we are required to do so for legal reasons.

3.   Third Party Materials

The AI Tools use multiple sources to answer questions, including but not limited to delta.com, Visa Run Inc. (d/b/a “Sherpa”) and the International Air Transport Association (IATA). Delta, Sherpa, and IATA cannot guarantee accuracy of, and accept no liability for, information about travel restrictions or visa and entry requirements. Delta is not responsible for any goods or services offered by Sherpa or other providers.

4.   Updates and Discontinuation of Service

Delta may from time to time provide enhancements or improvements to the features and functionality of the AI Tools, which may include patches, bug fixes, updates, upgrades, and other modifications (“Updates”). Updates may modify or delete certain features and/or functionalities of the AI Tools. Delta has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the AI Tools to you. All Updates will be deemed to constitute an integral part of the AI Tools and will be subject to these AI Terms. Delta reserves the right to discontinue the AI Tools at any time.

5.   Ownership of AI Tools

We retain all our respective rights, title, and interest, including intellectual property rights, in and to       the AI Tools. Other than the rights of access and use expressly granted in these AI Terms, these AI Terms do not grant you any right, title, or interest in or to the AI Tools.

6.   Disclaimer of Warranties and Limitations on Liability

No warranty or representation is made that the Services or any part or function, including without limitation any transactional function, will be available and not subject to interruption at any time. No warranty or representation is made that any Service or function, including without limitation any downloadable files available on the Delta websites or mobile apps, is free of computer viruses, malware or other destructive or harmful programs, software, code or devices that may erase, scramble, lock or disable any computer software, content or equipment or may prevent users from using a site or any other item of hardware or software. You should routinely scan your system and downloaded files for such disabling devices.

The AI Tools provide responses that are artificially generated and may contain inaccuracies. Delta provides the AI Tools on an “AS IS” and “AS AVAILABLE” basis, and disclaims all warranties, responsibility, and liability to you or others to the extent permitted by law. We make no guarantees that use of the AI Tools will be safe, secure, or error-free, or will function without disruptions, delays, or imperfections. You should not rely solely on the responses provided by the AI Tools. If the AI Tool is unable to answer your question, the information provided by the AI Tools conflicts with other official information, or you require further assistance, you may contact a Delta Reservations specialist.

Accuracy

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELTA MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE ACCURACY OF ANY OUTPUT. YOU SHOULD NOT RELY SOLELY UPON OUTPUTS FOR ANY PURPOSE OR USE OUTPUTS TO INFORM IMPORTANT DECISIONS. IF YOU PLAN TO USE OUTPUTS FOR ANY REASON, IT IS YOUR SOLE RESPONSIBILITY TO VERIFY THE OUTPUTS. OUTPUT FROM THE AI TOOLS MAY NOT REFLECT ACCURATE, COMPLETE, OR CURRENT INFORMATION.

Warning Regarding Output

AI will generate Output based on Prompts that you provide. The specific Output that the AI Tools will return based on your Prompts cannot be predicted in advance. AI TOOLS MIGHT GENERATE CONTENT THAT YOU CONSIDER OFFENSIVE OR OBJECTIONABLE AND/OR THAT DOES NOT REPRESENT DELTA’S VIEWS. BY AGREEING TO THESE AI TERMS AND BY USING THE AI TOOLS, YOU RECOGNIZE AND ASSUME THE RISK THAT THE PROMPTS YOU PROVIDE MIGHT RESULT IN GENERATION OF OUTPUT THAT YOU CONSIDER OFFENSIVE OR OBJECTIONABLE. YOU ALSO RECOGNIZE AND AGREE THAT YOU – NOT DELTA – ARE RESPONSIBLE FOR YOUR USE OF, AND ANY ACTIONS YOU TAKE IN RELATION TO, OUTPUT GENERATED BY THE AI TOOLS BASED ON YOUR PROMPTS.

Limitations on Liability

Delta’s liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these AI Terms or the AI Tools (however caused and on any theory of liability, including negligence), even if Delta has been advised of the possibility of such damages.

The laws of some states or jurisdictions may not allow the exclusion or limitation of certain damages, so some or all of the exclusions and limitations set out above may not apply to you. Notwithstanding anything to the contrary in these AI Terms, in such cases, Delta’s liability will be limited to the fullest extent permitted by applicable law.

Indenização

You agree to indemnify and hold Delta and its subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from and against any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) use of the AI Tools; (b) violation of these AI Terms or any law or regulation; or (c) violation of any right of a third party.

7.   Reporting Abuse, Errors, or Unexpected Outputs

If you suspect that an AI Tool is being used in a manner that infringes on your rights or the rights of other people or violates these AI Terms, or an AI Tool returns inaccurate, unexpected or unclear Output, or you otherwise discover errors with our AI Tools, you can contact us through the following methods:

When reporting an issue, please include the following details:

  • The URL of the page where the issue was found.
  • A description of the issue.
  • Any additional information that might help us understand and correct the issue.

8.   Severability

If any portion of these AI Terms is found to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it cannot be made enforceable, then it will be severed and the remaining portion will remain in full force and effect. If we fail to enforce any of these AI Terms, it will not be considered a waiver. Any amendment to or waiver of these AI Terms must be made in writing and signed by us.

9.   Changes to AI Terms

We work constantly to improve our Services and develop new features to make our products better for you and our community. As a result, Delta may need to update these AI Terms from time to time to accurately reflect our Services and practices, to promote a safe and secure experience, and/or to comply with applicable law. If required by law, we will notify you of any material changes to these AI Terms. Once any updated AI Terms are in effect you will be bound by them if you continue to use our Services, and your continued use of the Services indicates your acceptance of the updated AI Terms. If you do not agree to the updated AI Terms, you should stop using the Services before they go into effect.
